These General Terms and Conditions (in the Hungarian original: Általános Szerződési Feltételek, “ÁSZF”; hereinafter: Terms) govern the use of the subscription-based software service (SaaS) named Mentio, operated by the Service Provider.
2. Definitions
- Service / Mentio: the Service Provider’s web-based application that measures and analyses how a hotel appears in the answers of generative AI assistants (e.g. ChatGPT, Claude, Gemini, Perplexity), and provides related visibility and GEO analyses.
- Subscriber / User: the legal entity or sole proprietor that registers for and uses the Service.
- Subscription: use of the Service against payment of a fee, for an indefinite term, cancellable at any time.
3. Formation of the contract, registration
The contract is concluded electronically, upon the User’s registration and acceptance of these Terms. The User must provide true and accurate data during registration.
The Service is intended for business (B2B) use; by registering, the User declares that it enters into the contract in the course of its economic or professional activity.
Registration requires confirmation of the e-mail address (with a one-time code). The Service Provider is entitled to refuse registration or to suspend access in the event of a breach of these Terms.
4. Scope of the Service
Mentio performs regular, automated measurements in AI assistants and, based on these, provides visibility metrics, competitor comparisons, trends, source analysis and a website GEO audit.
The Service Provider continuously develops the Service and is entitled, where justified, to modify its features, the AI engines examined and the measurement methodology.
Nature of the results: the answers of AI assistants are inherently variable and probabilistic. The metrics reported by Mentio are estimates based on snapshots; the Service Provider does not guarantee any specific position, mention or business outcome.
5. Fees, invoicing
The Service is subscription-based: following registration, full use of the Service is subject to payment of a fee.
The subscription fee is determined by the current pricing displayed at the time of registration and on the website. Fees are net amounts, to which the applicable VAT is added.
The Service Provider may introduce or modify the payment process (e.g. card payment); the User will be informed in advance of its introduction.
The Service Provider issues electronic invoices for the fees, based on the billing details provided by the User. The User is responsible for the accuracy of the billing details provided.
The Service Provider is entitled to modify the fees; affected subscribers will be notified by e-mail within a reasonable time before the change takes effect. Continued use of the Service constitutes acceptance of the fee change; in case of disagreement, the User may cancel the subscription.
6. Termination of the subscription, cancellation
The subscription is for an indefinite term and may be cancelled by the User at any time, without giving reasons, via the interface or by e-mail sent to the Service Provider.
In the event of cancellation, the Service remains available until the end of the billing period already paid for and commenced; fees already paid for the commenced period are not refunded, unless the law or the Service Provider provides otherwise.
The Service Provider is entitled to terminate the contract with immediate effect if the User seriously breaches these Terms (e.g. improper, abusive or unlawful use of the Service).
7. Obligations of the User
- The User shall provide true data and ensure the security of their account;
- the User shall use the Service lawfully and in accordance with these Terms;
- the User shall not attempt to circumvent, overload or reverse-engineer the system, or to abuse it through automated queries;
- the User shall only enter data (e.g. hotel, website) that they are entitled to use.
8. Limitation of liability
The Service Provider provides the Service on an “as is” basis and uses reasonable efforts to ensure continuous availability, but does not guarantee error-free or uninterrupted operation.
The Service Provider is not liable for the content, accuracy or availability of the answers of AI providers (e.g. OpenAI, Anthropic, Google, Perplexity), nor for any consequences arising from changes thereto.
The Service Provider’s liability is limited — to the fullest extent permitted by law — to the amount of the subscription fees actually paid by the User in the 6 months preceding the event giving rise to the claim. The Service Provider is not liable for indirect or consequential damages (e.g. loss of profit).
9. Intellectual property
Mentio, its software, appearance, brand marks and content are the intellectual property of the Service Provider (or its licensors). For the term of the subscription, the User receives a non-exclusive, non-transferable right of use, for the intended use of the Service.
Data entered by the User remains the property of the User; the Service Provider processes such data for the purpose of providing the Service, in accordance with the Privacy Policy.
10. Data protection
The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.
11. Complaints, disputes
The User may submit complaints at hello@mentio.hu; the Service Provider will investigate them within a reasonable time.
This contract is governed by Hungarian law. The parties shall primarily seek to settle their disputes amicably; failing that, the Hungarian court having jurisdiction and competence shall proceed.
12. Amendment of the Terms, final provisions
The Service Provider is entitled to amend these Terms; subscribers will be informed of the amendment by e-mail or via the interface before it takes effect. Continued use of the Service constitutes acceptance of the amended Terms.
If any provision of these Terms is invalid, this shall not affect the validity of the remaining provisions.
